Borderline Ethical????
What duties does a listing agent have to ensure the information that the seller provides is correct?? I recently have two transactions that to me border on being unethical.
House number one states in MLS that the house has had foundation work completed and that there is a lifetime warranty on the foundation. In the area that I am in…Dallas Fort Worth…this is fairly normal due to the clay soil. We write a contract and go into option. The flooring in the master visibly leans and the home inspector suggest a foundation company check it out. After talking to a rep from the company that did the foundation I learn that the work done was interior only and that the interior work is in warranty. After calling several times the rep admits that the house needs exterior piers and that if exterior piers are added then the warranty on the interior is voided.
House number two also states that the house had foundation work completed and that it also has a lifetime warranty. After writing a contract I call the foundation company to see how the “lifetime” warranty is transferred. The number had been disconnected and no longer at the location stated on the warranty. I have called the listing agent to let him know and to see if there is another number for this company…
Does the listing agent have a duty to make sure what is in MLS is a true statement??
All the more reason you need to KNOW your agent.....
